Billionaire investor Kevin O’Leary said regulatory uncertainty in the US is limiting the expansion of the tokenization market, underscoring legal clarity as a prerequisite for institutional capital to enter the space.

CoinDesk reported on May 6 that O’Leary told Consensus 2026 Wall Street’s tokenization boom is "largely overhyped" until lawmakers put a regulatory framework in place.

Bitcoin remains a niche asset, he said, and institutions will not adopt it aggressively without federal regulatory clarity.

O’Leary also called tokenization an innovative technology that can shorten payment times and lower costs. Even so, institutions want legal certainty before committing capital.

He added that stablecoin adoption has accelerated since passage of the GENIUS Act, a US stablecoin bill.

Institutional investors are focused mainly on Bitcoin and Ether, O’Leary said, with little broad interest in most altcoins.
