Previously, the SEC had filed a lawsuit against Kraken for allegedly operating unregistered securities, and the court had ruled that the SEC appropriately argued that virtual assets (cryptocurrencies) traded on Kraken could be considered securities.

Kraken had applied for an interlocutory appeal against this, but the court dismissed it.
