The rumor that Wintermute would sue Binance arose following the crash on October 11. Earlier, CEO Gaevoy said in an interview, "Binance's automatic liquidation (ADL) system clearly operated abnormally," and added, "Some trading firms suffered unfair losses, and I understand that they are preparing legal action against Binance."
