Summary

  • The US SEC said it will continue accepting additional comments from industry participants and the public even after the official comment period closed for its Regulation Crypto proposal.
  • The proposal would create a new securities-law exemption that could apply when crypto issuers in the US raise funds, and includes a framework for granting regulatory exceptions to certain token issuances and fundraising activities that meet specified requirements.
  • Industry participants asked for clearer rules on how to determine whether a token is a security, airdrops, and secondary-market trading, but the additional comment process does not mean the official comment period has been extended or that the proposal has been finalized.

The US Securities and Exchange Commission will continue accepting additional comments from industry participants and the public on its proposed cryptocurrency rules even after the formal comment period has closed.

Eleanor Terrett, host of Crypto in America, reported on Oct. 20 that an SEC spokesperson said comments would still be accepted after the deadline for the agency’s proposed “Regulation Crypto” rule, whose public comment period ended that day.

The spokesperson encouraged commenters to submit their views within the designated window, but said the SEC would continue to receive public comments after the official period ends.

The proposal centers on creating a new securities-law exemption that could apply when crypto issuers in the US raise funds. It includes a framework for allowing regulatory exceptions for certain token issuances and fundraising activities that meet specific requirements.

Bitwise Asset Management and the Hyperliquid Policy Center were among industry participants that previously asked the SEC to revise the proposal. In particular, they called for clearer standards on when a token should be treated as a security, as well as clearer rules on airdrops and secondary-market trading.

By continuing to accept comments after the formal cutoff, the SEC has opened the door to additional industry feedback on the proposal. Still, the move does not amount to an extension of the official comment period or mean the proposal has been finalized. The agency has not yet decided whether to adopt the final rule or when it would take effect.
